    National Herald case: Court shares ECIR, complaint with accused, hearing on Sep 26

    The Rouse Avenue Court on Tuesday confirmed that copies of the Enforcement Case Information Report (ECIR) and BJP leader Subramanian Swamy’s 2014 complaint have been handed over to all proposed accused in the National Herald money-laundering case.

    The court noted that these documents were already taken on record earlier and clarified that Tuesday’s proceedings were confined to ensuring compliance with that order. “For the purpose of transparency, the court is adopting this modality,” the judge said, adding that respondents can now advance any formal arguments regarding the documents.

    During the hearing, counsel for Dotex Merchandise Pvt Ltd argued that the company’s name does not figure either in the ECIR dated June 30, 2021, or in Dr Swamy’s complaint dated July 4, 2014.

    The matter will now be taken up on September 26 for further clarifications.

    On the previous date, the court had allowed the ED’s application to place its ECIR and Dr Swamy’s complaint on record and directed that copies be furnished to the proposed accused, giving them time to examine the material and respond.

    The court had earlier reserved its order on taking cognisance of the chargesheet filed against Congress leaders Sonia Gandhi, Rahul Gandhi and others in the National Herald money-laundering case. Since then, it has been seeking clarifications from the ED and is yet to pronounce its order on cognisance.
