The Supreme Court has delivered an interim order on the amended Waqf Act, declining to stay the entire statute. In an exclusive interview with India Today TV, Senior Counsel Dr Abhishek Manu Singhvi explains the court’s decision, arguing against the narrative that it is a setback for the petitioners. He states, “I believe we got 70 to 80% of the major irritants stayed.” The order includes a stay on provisions related to the disqualification of a member for not being a five-year practicing Muslim and the de-recognition of a property’s Waqf status during an inquiry. The court also specified that Waqf boards and councils must have a Muslim majority. However, Dr. Singhvi expresses disappointment that the court did not stay the deletion of the ‘Waqf by user’ concept, which he considers a significant part of the case.
