    Exclusive | What’s at stake in a Taylor Swift and Travis Kelce prenup as pop star has ‘more to protect’ with $1.6B fortune: experts

    Taylor Swift and Travis Kelce are set to tie the knot after getting engaged, but legal experts advise that the wealthy power couple star prepare an ironclad prenuptial agreement before they say “I do.”

    “A prenup makes total sense for them. Taylor is reportedly worth around $1.6 billion, and Travis has about $90 million. That’s a huge difference,” Kara Chrobak, founding partner of Bespoke Law, tells Page Six Tuesday.

    “Having a prenup lets them both go into the marriage knowing their separate assets are protected and avoids messy, expensive litigation if things don’t work out. For people at their level, it’s really about peace of mind and keeping things private, not about planning for divorce.”

    Attorney Morgan Mazor agrees, “A prenup protects what they’ve already built. A prenup can spell out exactly what’s ‘yours, mine, and ours,’ without any fumbles later.”

    Chrobak further explains that some of the terms Swift, 35, will want to include are protections for her touring revenue and brand deals, while Kelce, also 35, will want to make sure his NFL contracts, endorsement deals and business ventures — like his “New Heights” podcast — remain separate assets.

    There will have to be a discussion, however, of how any earnings made while they are married will be divided should a potential divorce take place in the future.

    Chrobak also advises that A-listers like Swift and Kelce explicitly note restrictions surrounding their “name, image, and likeness rights” in a prenup.

    “Both of them are brands as much as people, so the prenup should make sure neither can exploit the other’s image or name if things fall apart,” she says.

    “Then you’ve got confidentiality. At their level of celebrity, a non-disparagement and strict confidentiality clause is critical to prevent memoirs, leaking details, and messy headlines.”

    Swift has monetized her personal experiences her entire career via candid song lyrics, so it’s possible that Kelce’s prenup terms could affect what she writes about if they were to split.

    Mazor agrees, “I would also imagine an NDA is also a significant part of the prenup.”

    Chrobak says that “without question” the Grammy winner “has more to protect,” primarily because her fortune is 18 times larger than Kelce’s who has an approximate net worth of $90 million.

    Swift’s estimated $400 million music catalog, $160 million streaming deals and $370 million touring revenue are just some of the contributors to her impressive financial portfolio.

    She also owns approximately $80 million in real estate, with properties in New York City, Rhode Island and Florida, and was rumored to have gone house-shopping with Kelce for another home in Cleveland.

    “For practical stuff, they’ll want clear rules for joint property, plus they should pick which state’s laws apply, since that can change how assets are divided,” Chrobak says.

    “If there’s no prenup and their assets get commingled, even a small percentage of Taylor’s wealth would be life-changing for him, while any payout he might owe her would barely dent her billion-dollar empire.”

    Lawyer Holly Davis advises that Swift clearly define the assets sooner rather than later because “Travis could, if they divorced, argue that a portion of Taylor Swift’s money that she had prior to their marriage could be part of the assets divided between the two in the event of a divorce.”

    The founding partner of the Texas-based law firm Kirker Davis also points out that Kelce’s NFL career is likely to end soon so he may be “negotiating more specifically in this prenup if he is looking to retire in a few years.”

    Attorney Kirk Stange agrees, “Given Travis may be near the end of his NFL career and Taylor will likely continue producing music for years, Taylor stands to lose significantly more without a prenup.”

    Mazor also stresses that Swift “has already fought enough legal battles,” referencing how the “Shake It Off” singer has just regained ownership of her masters following a years-long crusade.

    “A prenup guarantees she remains the sole owner of her music,” the Bender and Crane lawyer says.

    “Taylor’s career is not only stable, it’s skyrocketing. She’s in her billionaire era, commanding record-breaking tour revenues, streaming numbers, and endorsement deals. She’s her own economy.”

    The attorney advises, “One thing that it’s critical to eliminate in a prenup like this one is spousal support, because they’re both independently multi-millionaires.”

    It’s unknown whether Swift or Kelce have even begun thinking about a prenup. Their reps did not immediately return Page Six’s request for comment.

    However, the power couple is likely still in their love bubble, as they just broke the news of their engagement on Tuesday in a joint post via Instagram that said, “Your English teacher and your gym teacher are getting married 🧨.”

    Kelce got down on one knee with an old mine brilliant-cut sparkler that he co-designed with jeweler Kindred Lubeck of Artifex Fine.

    Page Six exclusively learned the Super Bowl champ actually popped the question “a couple of weeks ago,” so the pair has been keeping the happy news a secret for a while.

    Meanwhile, we’re told the Kelce family is over the moon and they’re all “thrilled” to have Swift be part of their growing family.
