NEW DELHI: The Supreme Court on Monday put on hold the Calcutta high court’s order that had imposed an interim stay on the new list of Other Backward Classes (OBCs) released by the West Bengal government.A bench led by Chief Justice of India BR Gavai, and also comprising Justices K Vinod Chandran and NV Anjaria, passed the interim order while issuing notice on a Special Leave Petition filed by the state government. The Court listed the matter for further hearing next Monday.The West Bengal government had approached the Supreme Court challenging the Calcutta high court’s interim stay on the new OBC list. “Prima facie, the high court order seems to be erroneous,” the bench said.On June 17, the Calcutta high court had stayed the state’s notifications granting reservations to 140 subcategories under the OBC-A and OBC-B categories.At the beginning of the hearing, the Supreme Court bench heard submissions by senior advocate Kapil Sibal, representing the state. The bench remarked, “This is surprising. How can the high court pass such an order? Reservation is part of the executive function.”The new OBC list had been prepared by the West Bengal government after the high court, in May 2024, cancelled the inclusion of 77 communities from the earlier OBC list.
