    Supreme Court upholds life for advocate in acid attack case – The Times of India

    NEW DELHI: SC Monday confirmed the life sentence and Rs 1 lakh fine imposed on an advocate found guilty of throwing acid on a woman, but reduced the sentence of his 73-year-old army officer father to 10 years’ imprisonment, given his age and illness.Giving final verdict on a 2014 incident that took place in Govind Nagar Police Station area of Mathura, a bench of Justices A S Oka and A G Masih said the advocate convict, Umesh, “was not only well read in law but owed a duty to the court being its officer requiring him to conduct with dignity, respect law and fellow beings. Having let down the community, we are not inclined to interfere with the sentence awarded to him”.The trial court had said that the father-son duo, Hakim and Umesh, one being a retired army personnel and the other an advocate, had aggravated their sentence resulting in life imprisonment with fine. On the other hand, the third accused, 19 years old at the time of the incident, was awarded 10 years’ imprisonment with the hope that he had a chance for reformation. While the father-son duo was fined Rs 1 lakh each, the 19-year-old was ordered to pay Rs 50,000.They had attacked the woman for lodging a complaint against them with the police by waylaying her. After the acid attack on the woman, her family was threatened by the accused, because of which they had to leave Mathura to save and protect themselves apart from getting treatment for the injured woman.Repelling the doubts over the veracity of statements of witnesses, the bench said, “A witness cannot be expected to have a photographic memory or recall every detail, as the mind does not function like a video recorder. Witnesses are often overtaken by unforeseen events, and their faculties may not register all particulars.”
