Top court to hear plea against Nishikant Dubey over ‘anarchy’ remarks on Monday

The Supreme Court will likely hear a plea seeking contempt action against BJP MP Nishikant Dubey, citing his derogatory remarks against the top court and the Chief Justice of India, Sanjiv Khanna, reported news agency ANI.

Dubey recently sparked a row by saying that the “Supreme Court is taking the country towards anarchy” and that “Chief Justice of India Sanjiv Khanna is responsible for the civil wars taking place in the country”.

The video of this speech went viral and triggered a wave of attacks against the Supreme Court.

Following this, the Supreme Court Bar Association (SCBA) passed a resolution on April 22 condemning the remarks made by the BJP leader.

The SCBA submitted, “This statement is not only defamatory but also amounts to contempt of the Supreme Court. This attack on the Supreme Court, as an Institution, and qua the Chief Justice of India, Mr. Justice Sanjiv Khanna, as an individual, is unacceptable and must be dealt with in accordance with the law.”

“The Association in its resolution has urged the Attorney General of India to grant consent for initiating contempt proceedings against Dubey for protecting the dignity of CJI Khanna”, added SCBA.

The petition, filed by Advocate Vishal Tiwari, also seeks directions from the Union Home Ministry to issue an advisory to all Chief Secretaries of states to curb hate and provocative speeches by political parties and their leaders related to the Waqf (Amendment) Act, 2025.

Advocate Narendra Mishra mentioned the plea before a bench of Justices BR Gavai and AG Masih, claiming that letters were given to the Attorney General and Solicitor General for the initiation of contempt proceedings against the BJP MP, but no action was taken.

In his letter petition he said, “These statements are false, reckless, and malicious, and they amount to criminal contempt” and requested directions from the court to remove social media posts and videos which are derogatory and contemptuous towards the judiciary.

The matter is listed before a bench headed by the Chief Justice for Monday.
